  • You agree to be legally bound by these Terms & Conditions and our Privacy Policy;

  • These terms apply to all visitors, users, and customers of this website.


We reserve the right to update or modify these Terms & Conditions at any time. Changes will take effect from the date of publication on this website. Your continued use of the website after changes are published constitutes your acceptance of the revised terms.


3. Products & Product Descriptions

3.1 Product Information

We make every effort to ensure that product descriptions, images, and specifications are accurate. However, we do not warrant that product descriptions or other content on this website are error-free. Product colours and textures may vary slightly from those shown on screen due to differences in monitor settings and photographic lighting.


3.2 Hair Extension Products

In particular, please note the following in relation to our hair extension products:

  • Hair extensions are personal hygiene products. For health and safety reasons, and in accordance with the EU Consumer Rights Directive, the right to cancel (see Section 7) does not apply to hair extensions that have been opened, removed from their original packaging, or have come into contact with hair or skin.

  • Hair extensions are made from human hair. Slight variations in colour, texture, and weight are natural and do not constitute a defect.

  • Detailed care instructions are provided with each product. Failure to follow care instructions may void your right to return a faulty product.

  • We reserve the right to limit quantities of any product sold.


3.3 Availability

All orders are subject to availability. We reserve the right to discontinue any product at any time without notice. In the event that a product is unavailable after your order has been placed, we will notify you as soon as possible and offer a full refund or alternative product.


4. Ordering & Contract Formation

4.1 Placing an Order

When you place an order on our website, you are making an offer to purchase the relevant products. Your order constitutes an offer to buy from us at the price specified at the time of order.


4.2 Order Confirmation

An automated email confirming receipt of your order does not constitute acceptance of your order. A contract between you and us is formed only when we send you a dispatch confirmation email, confirming that the products have been sent.


4.3 Order Refusal

We reserve the right to refuse or cancel any order at our discretion, including (but not limited to) where:

  • A product is listed at an incorrect price due to a typographical or technical error;

  • We suspect fraudulent activity;

  • Payment cannot be successfully processed;

  • Products are out of stock.


If we cancel an order after payment has been taken, we will issue a full refund promptly.


5. Pricing & Payment

 

5.1 Prices

All prices displayed on this website are in Euro (EUR) and include VAT at the applicable Irish rate, unless otherwise stated. Prices do not include delivery charges, which are displayed separately at checkout.

We reserve the right to change prices at any time. The price you pay is the price displayed on the website at the time you place your order, except in cases of obvious error.


5.2 Payment Methods

We accept the following payment methods: Visa, Mastercard, Stripe. All payments are processed securely through our payment providers. We do not store your full card details on our servers.


5.3 Pricing Errors

In the event of an obvious pricing error, we are not obliged to supply products at the incorrect price. We will notify you of the error and offer you the option to proceed at the correct price or cancel your order for a full refund.


6. Delivery

6.1 Delivery Areas

We deliver to addresses in the Republic of Ireland, Northern Ireland, UK and EU Member States. Delivery to other destinations may be available — please contact us for details.


6.2 Delivery Timeframes

We aim to dispatch orders within 1–3 business days of receiving payment confirmation. Estimated delivery times are:

  • Republic of Ireland: 2–5 business days

  • Northern Ireland / UK:[3–7 business days

  • EU: 5–10 business days


These are estimates only and not guaranteed delivery dates. We are not liable for delays caused by events outside our control, including postal or courier disruptions.


6.3 Risk & Title

Risk in the goods passes to you upon delivery. Title (ownership) in the goods passes to you upon our receipt of full payment.


6.4 Failed Delivery

If a delivery attempt is unsuccessful, our courier will leave a notification card. If goods are returned to us due to non-collection or an incorrect address provided by you, we may charge a re-delivery fee or deduct original delivery costs from any refund.


7. Your Right to Cancel, Returns & Refunds

7.1 Your Statutory Right to Cancel (Distance Selling)

Under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (implementing EU Directive 2011/83/EU), you have the right to cancel your order within 14 calendar days from the day after you receive your goods, without giving any reason, subject to the exceptions set out below.


7.2 Exceptions to the Right to Cancel

The 14-day right to cancel does NOT apply to:

  • Sealed goods which have been unsealed after delivery and which are not suitable for return due to health protection or hygiene reasons — this includes all hair extensions and hair accessories once the hygiene seal or original packaging has been opened or broken;

  • Goods made to your specification or clearly personalised (e.g. custom colour orders);

  • Goods that have been used, styled, cut, or otherwise altered.


Unopened hair care products (shampoos, conditioners, treatments) that remain in their original sealed packaging may be returned within 14 days.


7.3 How to Cancel

To exercise your right to cancel, you must notify us clearly before the cancellation period expires. You can:

  • Email us at karen@cascatahair.ie with your order number and a clear statement that you wish to cancel;

  • Complete and send the model cancellation form (below or appended);


7.4 Returning Goods

If you cancel, you must return the goods to us within 14 days of notifying us. Unless the goods are faulty or misdescribed, return postage costs are your responsibility. We recommend using a tracked postal service as we cannot be responsible for items lost in transit.

7.5 Refunds

Subject to the above exceptions, we will reimburse you all payments received, including the cost of standard delivery (but not any supplementary delivery costs if you chose a faster delivery option), without undue delay and within 14 days of receiving the returned goods or evidence that you have returned them, whichever is earlier.


We will use the same method of payment you used for the initial transaction unless you expressly agree otherwise. We may deduct from the refund if the value of the goods has diminished due to handling beyond what is necessary to establish their nature, characteristics, and functioning.


7.6 Faulty or Misdescribed Goods

Nothing in these Terms & Conditions affects your statutory rights. If goods are faulty, misdescribed, or not fit for purpose, you may be entitled under the Sale of Goods and Supply of Services Act 1980 (Ireland) and applicable EU consumer law to:

  • A repair or replacement; or

  • A full or partial refund.

8. Data Protection & Privacy

We are committed to protecting your personal data. Our collection and processing of your personal data is governed by our Privacy Policy, which forms part of these Terms & Conditions and is available on our website.

We process your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Data Protection Acts 1988–2018 (Ireland). By using this website or purchasing from us, you acknowledge that we will process your personal data as described in our Privacy Policy.

All content on this website, including but not limited to text, product descriptions, photographs, logos, graphics, videos, and software, is the property of CASCATA Hair Limited or our licensors and is protected by Irish and EU copyright and intellectual property law.


You may not reproduce, distribute, modify, transmit, reuse, or use the content of this website for any commercial purpose without our express written permission. You may print or download content for personal, non-commercial use only.


10. Acceptable Use of This Website

You agree not to use this website:

  • In any way that violates any applicable local, national, or international law or regulation;

  • To transmit, send, or upload any unsolicited or unauthorised advertising or promotional material;

Nothing in these Terms & Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under Irish law, including consumer protection legislation.


Your statutory rights as a consumer are not affected by these terms.

13. Reviews, Comments & User-Generated Content

If you submit reviews, comments, photographs, or other content to our website or social media pages, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, edit, and publish such content for marketing and promotional purposes, including on our website and social media channels.


You confirm that any content you submit is your own, does not infringe any third-party rights, and is not defamatory, offensive, or otherwise unlawful. We reserve the right to remove any content at our discretion.

These Terms & Conditions are governed by and construed in accordance with the laws of Ireland. Any disputes arising from or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Ireland.


If you are a consumer resident in another EU Member State, you may also be entitled to bring proceedings in the courts of your country of residence under EU consumer protection law.
